These Terms of Service (“Terms”) govern the use of the website and services offered by Bytebloom Studios (“we”, “us”, “our”).
By accessing our website, purchasing a plan, or using our services, you agree to these Terms.

2. Services We Provide

We offer digital services including:

  • Web design & development

  • UX/UI design

  • Branding & content creation

  • SEO & performance optimization

  • Hosting & website maintenance

  • Technical support

  • Custom development & automation

  • Website care plans (Essential / Professional / Ultimate)

The exact deliverables for each project or plan are defined in the respective package description, proposal, or written agreement.

 
3. Website Care Plans

We provide three maintenance plans:

3.1 Essential Plan

Includes:

  • Managed hosting

  • Weekly backups

  • Basic security monitoring

  • Basic support (48–72h response time)

  • Monthly performance check

  • SSL management

3.2 Professional Plan

Includes everything in Essential PLUS:

  • Priority support (24–48h response time)

  • Monthly content updates (limited to agreed scope)

  • Monthly performance optimization

  • Speed improvements

  • Plugin & theme review

3.3 Ultimate Plan

Includes everything in Professional PLUS:

  • Priority queue (12–24h response time)

  • Monthly development time (2 hours included)

  • Advanced performance monitoring

  • Malware & troubleshooting support

  • Unlimited small updates within reason

These Terms apply equally to all plans unless otherwise stated.

 

4. Contract Term & Renewals
  • All plans require a minimum commitment of 12 months.

  • After the minimum term, the subscription renews monthly, unless cancelled.

  • Cancellations must be submitted 14 days before the next billing cycle.

  • No refunds are provided for partial periods or unused time.

5. Payments & Billing
  • Payments are billed monthly by invoice

  • Services must be paid in advance.

  • If a payment fails or is overdue for more than 7 days, services may be paused until payment is resolved.

  • If payment remains unpaid for 30 days, we may terminate the contract and remove hosting services.

  • Prices may be adjusted with 30 days’ notice.

 
6. Client Responsibilities

Clients agree to:

  • Provide accurate and complete project information

  • Deliver required content (text, images, logins) on time

  • Keep website login credentials secure

  • Ensure they have rights to all supplied materials

  • Not use hosting for illegal, harmful, or spam-related activities

We are not responsible for delays caused by missing content, access issues, or lack of feedback.

 

7. Hosting & Server Environment

If we provide hosting:

  • We aim for high uptime but do not guarantee uninterrupted availability

  • Maintenance windows may cause short-term downtime

  • Server outages caused by third-party providers are outside our control

  • We may migrate servers or adjust configurations when necessary

Clients must not:

  • Host illegal content

  • Upload malware or harmful scripts

  • Abuse server resources

  • Modify critical system files

8. Updates, Maintenance & Technical Work

We may perform updates for:

  • WordPress core

  • Themes

  • Plugins

  • Security

Clients acknowledge:

  • Updates may occasionally cause incompatibilities

  • We are not liable for issues caused by third-party plugins or themes

  • Certain updates require manual review and may be postponed for stability

  • Complex fixes or redesigns are not included unless part of the Ultimate plan or quoted separately

9. Backups

We perform backups according to each plan’s description.

Clients understand:

  • Backups are stored for a limited time

  • Backups do not guarantee full data recovery

  • We are not liable for data loss caused by third-party services or client actions

  • Restoring backups outside regular maintenance may incur additional costs

10. Support & Response Times

Support levels vary depending on the plan:

  • Essential: 48–72h response, weekdays only

  • Professional: 24–48h response, weekdays

  • Ultimate: 12–24h response, priority queue

Support excludes:

  • Large content uploads

  • Redesigns

  • Marketing work

  • SEO services

  • New page creation

  • Custom integrations

  • API development
    (unless included in your specific package)

Emergency support is only included in the Ultimate Plan.

 

11. Intellectual Property

Client ownership

All text, images, and materials provided by the client remain their property.

Work we create

After full payment, clients receive the rights to use the final deliverables for their intended purpose.

Our property

We retain ownership of:

  • internal tools

  • reusable components

  • frameworks

  • custom modules

  • design concepts not used in the final version

12. Portfolio Usage

We may display completed work in our portfolio or marketing materials unless the client requests otherwise in writing.

Confidential projects must be disclosed beforehand.

 

13. Third-Party Services

Websites may rely on external tools or providers (hosting, APIs, plugins, payment processors).
We are not responsible for failures, outages, or changes caused by these providers.

14. Liability

To the fullest extent permitted by law, we are not liable for:

  • data loss

  • downtime due to third-party providers

  • issues caused by client modifications

  • malware infections not caused by our negligence

  • indirect or consequential damages

  • losses caused by plugins, themes, or third-party tools

Our liability is limited to the amount paid by the client in the last 3 months of service.

 

15. Suspension of Services

We may temporarily suspend services if:

  • payments are overdue

  • malware or harmful activity is detected

  • the client violates these Terms

  • hosting abuse occurs

  • illegal content is hosted

We will notify the client whenever possible before suspending services.

 

16. Data Protection & Processing

We process personal data in accordance with our Privacy Policy.
If we host or maintain a client’s website, we act as a data processor, and a Data Processing Agreement (DPA) is available upon request.

 

17. Termination

Either party may terminate the agreement with proper notice (14 days before renewal).
Work completed before termination is billed accordingly.
Upon termination, we will provide optional website migration assistance for a fee.

 

18. Changes to These Terms

We may update these Terms when necessary.
The latest version will always be available on our website.
Continued use of our services constitutes acceptance of the updated Terms.
